Communications Data
Privacy Policy
This policy describes how we collect, use, and protect the personal information you share when you communicate with us — including via SMS text message, email, and phone. It also explains your rights and how to manage your communication preferences at any time.
Please read this policy carefully. By providing your contact information and engaging with our communication channels, you acknowledge receipt of this policy.
Information We Collect
When you interact with us through any communication channel, we may collect the following types of personal information. We collect only what is necessary to provide you with relevant communications and to comply with applicable laws.
| Data Type | Examples | Purpose |
|---|---|---|
| Contact identifiers | Name, phone number, email address | Deliver communications and maintain your preferences |
| Interaction data | Message open times, link clicks, response history | Improve message relevance and measure effectiveness |
| Consent records | Opt-in date, method of consent, opt-out requests | Comply with legal requirements and honor your choices |
| Device & network data | Carrier information, device type, IP address | Ensure message delivery and troubleshoot technical issues |
| Communication content | Messages you send to us, call recordings (where disclosed) | Respond to your inquiries and improve service quality |
SMS Text Messaging
By providing your mobile number and consenting to receive text messages, you agree to receive SMS communications from us. Message frequency varies based on your account activity and the programs you enroll in.
Message and data rates from your carrier may apply. We use SMS to send transactional updates (such as order confirmations and appointment reminders), service alerts, and — where you have separately consented — promotional offers. We will never use text messaging for unsolicited marketing without your explicit prior consent.
SMS Opt-In & Opt-Out
How to Opt In to SMS
- Text START to our short code from your mobile phone
- Verbally provide consent during a customer service call (confirmed via follow-up text)
- Consent is never a condition of purchasing any product or service
How to Opt Out of SMS
- Reply STOP, CANCEL, QUIT, UNSUBSCRIBE, or END to any message we send
- You will receive a single confirmation text and no further messages
- Exceptions: legally required notices (e.g., a regulatory communication) may still be sent
- Re-subscribe at any time by texting START to our short code
- For help, reply HELP to any message or contact us directly
We retain records of your SMS consent for a minimum of five years to comply with applicable telecommunications regulations.
Email Communications
We send two types of emails: transactional emails (receipts, account notices, password resets) and marketing emails (newsletters, promotional offers, product announcements). Transactional emails are sent as a condition of your account and cannot be opted out of while your account remains active. Marketing emails require your separate, affirmative consent.
All marketing emails comply with the CAN-SPAM Act, CASL (where applicable), and GDPR (for EEA residents). Each email includes a clear identification of the sender, a valid physical mailing address, and an unsubscribe mechanism processed within 10 business days.
Email Opt-In & Opt-Out
How to Opt In to Marketing Email
- Check an unchecked consent box during account registration or checkout
- Click a confirmation link in a double opt-in confirmation email (where required)
- Note: pre-checked boxes are never used for marketing consent
How to Opt Out of Marketing Email
- Click the Unsubscribe link in the footer of any email
- Contact our privacy team directly at info@agilehealthtech.com
- Opt-out requests are processed within 10 business days
- You may specify whether to unsubscribe from all marketing emails or only certain categories
We use pixel tracking and link-click tracking in marketing emails to measure campaign effectiveness. You can disable pixel tracking by configuring your email client to block remote images. This does not affect delivery of your emails.
Phone Communications
We may contact you by phone for account-related matters, service notifications, and — where you have consented — sales and marketing calls. All outbound calls comply with the Telephone Consumer Protection Act (TCPA), the FTC's Telemarketing Sales Rule, and applicable state laws including do-not-call regulations.
We do not use automated dialers or pre-recorded messages for marketing purposes without your prior express written consent. Calls to numbers on the National Do Not Call Registry are prohibited unless a specific exemption applies (such as an existing business relationship).
